OVERVIEW
This online store is operated by Katrina Laulea under the Notchural Kouture brand (“Notchural Kouture,” “we,” “us,” or “our”). Shopify provides the ecommerce platform that allows us to offer products and services to you.
These Terms of Service (“Terms”) govern your access to and use of the Notchural Kouture website, online store, products, content, and related services (collectively, the “Services”).
By visiting our store, purchasing a product, or otherwise using the Services, you agree to these Terms and our Privacy Policy, Return and Refund Policy, and Shipping Policy. If you do not agree, please do not use the Services.
- ONLINE STORE TERMS
You must be legally capable of entering into a binding agreement in your jurisdiction to make a purchase. If you are under the age of majority, you may use the Services only with the involvement and consent of a parent or legal guardian.
You may not use our products or Services for an unlawful or unauthorized purpose. You may not transmit malicious code, interfere with the operation of the Services, or violate another person’s rights.
- PRODUCT INFORMATION
We make reasonable efforts to display product descriptions, colors, measurements, sizing information, materials, and photographs accurately.
Colors and appearance may vary depending on lighting, photography, screen settings, manufacturing variations, and other factors. Because clothing fit can vary by body shape, fabric, and design, customers are responsible for reviewing the size guide and product description before purchasing.
We may modify or discontinue products without notice. We may also limit product quantities, sales, or availability by person, household, geographic area, or jurisdiction when reasonably necessary.
- PRICES AND PAYMENT
Prices are displayed in United States dollars unless otherwise stated. Prices, promotions, and product availability may change before an order is placed.
You agree to provide current, complete, and accurate billing, payment, shipping, and contact information.
Payments are processed using Shopify Payments or other third-party payment providers. Your payment method may be subject to additional terms imposed by your card issuer or payment provider.
Applicable taxes and shipping charges will be displayed during checkout when available.
- ORDERS
Submitting an order does not guarantee acceptance. We may accept, reject, limit, or cancel an order for reasons including:
• Suspected fraud or unauthorized activity;
• Incorrect pricing or product information;
• Product unavailability;
• Payment-processing problems;
• Shipping restrictions; or
• Violations of these Terms.
If we cancel an order after payment has been processed, we will refund the canceled amount to the original payment method.
We may contact you using the email address or telephone number provided with your order.
- ORDER CANCELLATIONS
Customers may request cancellation through Shopify within one hour after placing an eligible order.
After the one-hour cancellation window, contact notchuralkouture@gmail.com immediately. We cannot guarantee cancellation after an order enters processing or fulfillment.
If cancellation is no longer possible, an eligible physical item may be returned after delivery according to our Return and Refund Policy.
- SHIPPING AND DELIVERY
Shipping costs and available delivery options are displayed at checkout when available.
Delivery dates and transit times are estimates, not guarantees. Delays may occur because of carriers, weather, holidays, customs, incorrect addresses, high order volume, or events outside our reasonable control.
Customers are responsible for providing a complete and accurate delivery address. Additional costs resulting from an incorrect or incomplete address may be charged to the customer to the extent permitted by law.

- RETURNS AND REFUNDS
Eligible physical products may be returned within 30 days after delivery, subject to the conditions in our Return and Refund Policy.
Returned items must generally be unworn, unused, unwashed, unaltered, and returned with their original tags and packaging.
Unless an item arrives defective, damaged, or incorrect, the customer is responsible for return-shipping costs. No restocking fee is currently charged.
Items marked Final Sale, gift cards, delivered digital products, personalized items, and other excluded products may not be returnable except where required by law.
- DIGITAL PRODUCTS
Digital products are licensed for personal use and are not sold with ownership of their intellectual-property rights.
You may not reproduce, resell, distribute, share, publish, sublicense, or commercially exploit a digital product without our written permission.
Because digital products are delivered electronically, sales are generally final after delivery or access. Exceptions may be considered for duplicate charges, failed delivery, defective files, or when required by law.
- INTELLECTUAL PROPERTY
The Notchural Kouture name, NK logo, clothing designs, artwork, photographs, graphics, text, videos, downloads, website content, and other original materials are owned by or licensed to Notchural Kouture and are protected by applicable intellectual-property laws.
You may access the Services for personal shopping and informational use. You may not copy, reproduce, modify, distribute, sell, license, scrape, publish, or commercially exploit protected content without prior written permission.
No license or ownership interest is granted except the limited personal-use permission expressly stated in these Terms.
- CUSTOMER CONTENT AND FEEDBACK
If you voluntarily submit reviews, photographs, comments, suggestions, or other content, you confirm that you have the right to submit it and that it does not violate another person’s rights or applicable law.
You grant Notchural Kouture a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and share submitted content for operating, improving, and promoting the business, unless prohibited by law.
We may remove content that we reasonably believe is unlawful, misleading, abusive, infringing, or otherwise inappropriate.
- THIRD-PARTY SERVICES AND LINKS
The Services may use or link to third-party providers, including Shopify, ShipBob, payment processors, shipping carriers, social-media platforms, and analytics providers.
Third-party services are governed by their own terms and privacy policies. We are not responsible for the independent availability, content, security, or performance of third-party services, except to the extent required by law.
- PRIVACY
Our collection, use, and disclosure of personal information are described in our Privacy Policy.
Shopify and other providers may process personal information to operate the store, process payments, prevent fraud, fulfill orders, provide customer service, and perform other authorized services.
- PROHIBITED USES
You may not use the Services to:
• Violate any applicable law or regulation;
• Infringe intellectual-property, privacy, or publicity rights;
• Submit false or misleading information;
• Transmit malware or harmful code;
• Attempt unauthorized access to an account, system, or network;
• Collect another person’s information without authorization;
• Interfere with security or operation of the Services;
• Engage in fraud, abuse, harassment, or discrimination; or
• Resell or commercially exploit the Services or protected content without permission.
We may suspend or terminate access for violations of these Terms.
- ERRORS AND OMISSIONS
Information on the Services may occasionally contain typographical errors, inaccuracies, or omissions involving descriptions, prices, promotions, shipping charges, transit times, or availability.
We may correct errors, update information, or cancel affected orders when reasonably necessary. If a paid order is canceled because of our error, the canceled amount will be refunded.
- DISCLAIMER OF WARRANTIES
To the fullest extent permitted by law, the Services and products are provided “as is” and “as available,” except for any express warranty stated on a product page.
We do not guarantee that the Services will always be uninterrupted, secure, or error-free. Nothing in these Terms excludes warranties, remedies, or consumer rights that cannot legally be excluded.
- LIMITATION OF LIABILITY
To the fullest extent permitted by law, Notchural Kouture will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of, or inability to use, the Services or products.
Where liability cannot legally be excluded, our total liability relating to a claim will not exceed the amount paid for the product or order giving rise to that claim, except where applicable law requires otherwise.
- INDEMNIFICATION
To the extent permitted by law, you agree to be responsible for claims, losses, or reasonable expenses arising directly from your unlawful misuse of the Services, infringement of another person’s rights, or material violation of these Terms.
- SEVERABILITY
If any provision of these Terms is found unlawful or unenforceable, that provision will be limited or removed only to the extent necessary. The remaining provisions will continue in effect.
- TERMINATION
We may suspend or terminate your access to the Services when we reasonably believe you have violated these Terms, engaged in fraud, threatened the security of the Services, or acted unlawfully.
Obligations and liabilities arising before termination will continue to apply.
- GOVERNING LAW
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
Subject to consumer rights or laws requiring a different forum, disputes relating to these Terms will be handled in the appropriate state or federal courts serving Santa Clara County, California.
- CHANGES TO THESE TERMS
We may update these Terms from time to time. The current version will be posted with its revised date. Changes apply prospectively unless applicable law requires otherwise.
Continued use of the Services after revised Terms become effective constitutes acceptance of the revised Terms.
- ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, Return and Refund Policy, Shipping Policy, product descriptions, and checkout disclosures, constitute the agreement between you and Notchural Kouture concerning the Services.
